Form 4 vs Form 4473: Why We Still File Form 4
On August 5, 2026, a federal judge in the Northern District of Texas ruled in Silencer Shop Foundation v. ATF that the government cannot enforce NFA registration against certain parties now that the suppressor tax is $0. It is not a nationwide order. It covers the named plaintiffs, their members, and their customers. Since then, Silencer Shop lets buyers in 27 states fill out a Form 4473 and walk out with a suppressor the same day.
A 4473 is a point-of-sale record in a dealer’s book, not a federal registration. The ruling paused enforcement for some people, but it did not change the underlying law or address the rule against moving an unregistered suppressor across state lines. The government is not expected to appeal, so the ruling may stand for the people it covers. Even so, a court ruling is not the same thing as a registration.
