NFA Ruling and ATF Policy: 4473s Are Now an Option. We Still Recommend a Form 4.

On August 5, a federal court ruled that with the suppressor tax at $0, the NFA's registration rules can't stand on Congress's power to tax. On October 9, ATF announced that it will no longer require approval or registration for suppressors, and that policy applies to everyone (ATF open letter). Neither the ruling nor ATF's policy repealed the NFA or changed state law, and ATF says enforcement could resume.

Starting in mid-October, you can buy from us on a Form 4473 alone where state law allows it. At launch, that means home delivery in 18 states or pickup at our Texas store. Fifteen states still tie lawful possession to federal registration, so a 4473 isn't an option there. We still recommend a Form 4 for most buyers. ATF's own FAQ says "the NFA treats unregistered firearms as contraband" (ATF FAQ). A Form 4 keeps your suppressor compliant today and under future administrations. The tax is $0, and approvals come back in days. If we can't ship to your door in your state, we can ship to a local dealer you choose. You pick that option at checkout.

How Home Delivery Works

From Checkout to Delivery

This is the Form 4 process we recommend for most buyers. Our software checks the paperwork at each step before the Form 4 goes to the ATF.

Frequently Asked Questions

Suppressor Home Delivery Questions

Can a suppressor be shipped to your house?

Yes, in the 42 states listed below. Once the ATF approves your Form 4, you complete a Form 4473 online and we ship the suppressor to your residence following ATF Procedure 2020-1. You don't visit a gun store, and there's no transfer fee.

Does a suppressor have to be shipped to an FFL?

No, but it can be. When you buy from us, you choose at checkout whether we ship it direct to your door or to a local dealer of your choice. Federal law requires a dealer to deliver a suppressor in the state where you live (18 U.S.C. § 922(b)(3)). We keep a Capitol Armory location in each state we serve, so home delivery doesn't require another dealer in the middle.

Can I buy a suppressor online and have it shipped to my house?

Yes. Order on our site, upload your photo and fingerprints, and e-sign your eForm 4. We file it, keep you updated, and ship to your door after approval. The full walkthrough is on our how to buy a suppressor page.

Can a suppressor be shipped to my house without a Form 4?

Yes, under ATF's October 9 policy, in states that allow it. Starting mid-October, we offer 4473 suppressors shipped to your home in 18 states and at our Texas store. But ATF's own FAQ says "the NFA treats unregistered firearms as contraband," and ATF's policy can change. A Form 4 keeps your suppressor compliant today and under future administrations, so we still recommend a Form 4 for most buyers. 4473 vs. Form 4 Suppressors has the details.

Is it legal to have a suppressor delivered to your home?

Yes, in 42 states, with an approved Form 4 or, under ATF's October 9 policy, a 4473 where state law allows it. California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York, Rhode Island, and Washington, D.C. prohibit suppressors, so we can't ship there.

How is my suppressor shipped, and do I have to sign for it?

We ship by UPS or USPS. A signature is required at delivery, but you can waive it.

How long does it take to get a suppressor delivered?

We file your eForm 4 within 24 hours of receiving your fingerprints and photo. From there, approval timing is up to the ATF. Current averages for individuals and trusts are on our ATF wait times page. After approval, we contact you to finish the final paperwork, then ship.

Do I have to pick up my suppressor in person?

No. Your suppressor ships to your residence after approval. If you'd rather pick it up locally, we can ship it to a local dealer you choose, and you pick that option at checkout. Texas residents can also pick up at our Cedar Park location, on a Form 4 or a 4473.

Can I use an NFA trust with home delivery?

Yes. Upload your trust to your profile, or buy our 50-state NFA trust. Only the person on the trust who certifies the eForm 4 needs an ATF eForms account. Our 4473 home delivery is for individual buyers, so if you're buying on a trust, use a Form 4.

Who is Capitol Armory?

We are a licensed firearms dealer based in Cedar Park, Texas, and have held an FFL since 2008. Suppressors and NFA paperwork are our business. Call us at (512) 879-1068 or read why customers choose Capitol Armory.
