Form 4 Wait Times: Approvals Can Be Fast

Since March 2024, the ATF has not processed forms strictly first in, first out. A Form 4 can be approved as soon as the FBI background check clears. With the tax stamp now $0, the background check is the main variable in how long approval takes.

Filing as an Individual
Filing in your own name is the fastest route, with individual eForm 4s averaging 6 days in the latest ATF data because only one background check is required. The suppressor is registered to you alone, so no one else can legally possess it, and moving it into a trust later requires another Form 4. If speed matters most and you will be the only person using it, filing as an individual makes sense. If you want family members to use or inherit it, start with a trust.
How to Get a Quick Approval

Form 1 Wait Times
A Form 1 is the application to make your own NFA item, such as building a suppressor or an SBR. According to the ATF’s published averages, eForm 1 applications finalized in August 2026 took 21 days, while paper Form 1s took 79 days.
Paper forms can be straightforward to complete, so they remain an option if timing is not important. If you want the faster route, file electronically.
The same basic rule applies as with a Form 4: the ATF can approve the application when every background check clears. One responsible person with an instant Proceed is the fastest path, while multiple responsible persons or a manual FBI review can add time.

Form 3 Wait Times
A Form 3 moves a suppressor from one licensed NFA dealer to another and does not involve a background check on you, so it usually clears in 1 to 3 days.
Most of our customers never need one because about 90% have us handle their Form 4, which keeps the suppressor in-house from purchase through delivery. If you prefer to use a local dealer, we transfer the suppressor out on a Form 3.
Why ATF Wait Times Vary
Every responsible person on the form must pass an FBI NICS check. A computer-generated Proceed allows the ATF to approve the transfer right away. A delay sends the file to an FBI examiner for manual review, while a denial stops the transfer.

If you or someone on your trust receives a background check delay, the file goes to an FBI examiner for manual review. In most cases, that means approval takes a few months instead of a few days.

Since the August 5 ruling, Silencer Shop advertises same-day suppressors on a Form 4473 in some states. Unless the dealer already has your exact suppressor in stock, it still has to ship from Silencer Shop’s distribution center to that dealer, which can add days or weeks before pickup.

The August 5 Ruling: Don’t Skip Your Form 4 Over It
On August 5, 2026, a federal judge in the Northern District of Texas ruled in Silencer Shop Foundation v. ATF that the government cannot enforce NFA registration against certain parties now that the suppressor tax is $0. The ruling has been described as the end of NFA registration, but its scope is narrower:
- It is not a nationwide order, and it covers only the named plaintiffs, their members, and their customers.
- The government is not expected to appeal, but a ruling that stands is still not a registration, and a future administration, Congress, or a higher court could undo it.
- Other courts disagree, and just weeks later the Third Circuit upheld the suppressor registration requirement in United States v. Berger.
- It did not touch the NFA rule against moving an unregistered suppressor across state lines, which leaves hunting trips, moving to a new state, and shipping a suppressor to the manufacturer for warranty work all unresolved.
- 15 states still require federal registration under state law, whatever the ruling says.

How the ATF Notifies Approval
Electronic Form 4s never appear in your eForms dashboard, because the ATF emails the approved PDF instead. The NFA Branch may take up to 30 days to mail a paper Form 4 after approval, and forms submitted together can land on different examiners’ desks, resulting in staggered approvals.
Texas customers may pick up in person or choose direct-to-door shipping, while customers in other states complete a short form (4473) so we can ship to their residence.
If You Are Stuck in Delay
If your approval passes 90 days, call the NFA Branch at 304-616-4500 with your serial number ready. You can find it on your receipt and other paperwork. Ask to speak with your examiner. Some customers also reach out to a congressional office for extra pressure, although results vary.
